Back in October of 2010I was involved in a Hit and Run Accident. The Guy that hit us was found a few days later and we filed against his insurance. Me and my Fiance both went through Physical therapy for our backs. Medical bills totalled about 5K for me and about 8K for her. There were times when she was in tears because her back was hurting so bad. She Couldnt work some days either and she is self employed and works from home as a graphic Designer. I missed some days of work too but my pain was not near as much as hers. State Farm Called and offered a settlement with me to pay the 5k to the Doctor and then a $1000 check to me for my pain and suffering. They called my Fiance to settle but she did not answer. My guess is they will probably offer her the same. Is Paid medical bills plus $1,000 fair? We missed work from it. Delt with stress and Physical therapy for about 3 months and not to mention all of the inconveniences associated with getting the car fixed and also dealing with insurance stuff. The guy that hit us was found a few days later but never offered a good excuse as to why he hit us and then ran. He originally filed a false claim with State Farm and said that he hit a tree and not another vehicle. It was all overturned against him once Geico called them and submitted the police report. Allstate was supposed to compensate me for X amount of damage done to my car by the driver who had insurance upto 5 grand. Notice that I did not have insurance with AllState but that because the driver was at fault, and had coverage of upto $5000, AllState has agreed to pay me a portion of that 5 grand. However, the problem is the driver who was at fault is not agreeing to this and demands more in loss from AllState. Whereas, although, I myself deserve more in damage since the car was worth more than the amount I am being compenstated for, I have still decided to settle for less. Now because the driver is delaying the decision to accept the remaining amount out of 5 grand, this case/claim has not resolved SINCE 2010. They wouldn't send me check yet only because the driver needs to accept the offer also. My theory is that whether or not the driver finds the offer fair, is none of my problem. I shouldn't have to wait for 2 years only because the driver refuses their offer. I should get my share at least. Do I have a legal case against the company for taking too long in this regards ? What can I do to resolve this ?

Hello I have a question concerning a Traffic citation that i got 13 days ago. On the 21st of November i got pulled over for a blinker that was out on my car. I had bought this car from a friend 3 months ago and hadnt didnt redgister it into my name or have current tags. I had insurance for the first month that i had the car but then due to finacial problems couldnt afford the extra 220 a month for car insurance. So the State Trooper gave me a citition which written under the description only said no proof of insurance. So the a couple of days later i went and got insurance, redgistration, tags, license plates the whole nine yards and i went into the trooper station to clear the citation cause it is correctable but the lady tells me i have to show proof of insurance from the day of getting the citiation. so my only opition is either take this to court or pay a whooping 540$ and 6 points off my Driver's license i was wondering if i should take this to court?

Hi all, I currently have Allstate car insurance and I bought a new car with a LoJack installed. When I tried to get the discount, they only took off $7 per month on my policy.. Looking online, I discovered that New York state mandates that car insurance companies must give a discount for LoJack, but I'm not sure how much. Rear Ended - Can I demand insurance?

I was in an accident last month in my brand new Volvo (not even a month old!). I was rear-ended, while I was at a stop sign. Damage is to the rear bumper, pretty bad, looks horrible...especially for a new car! No one was hurt, just shaken! We did not immediately file a police report. We exchanged information, and the the person who hit me told me that they would pay for my repairs out of pocket, and that they didn't want to get the police or insurance involved. We conversed on the phone for a few days, and they seemed like everything was going great, and I was supposed to meet them at their friends auto body shop for the repairs...long story short...they never showed. Bad part now is, I never got their insurance information, just license plate, DL, addresses(basically everything BUT insurance). That same day, I went to the police station and filed a delayed police report. Later that week, I went and got 3 different estimates, and the damage averages out to about $900. I contacted a friend of mine, who is a police officer, and they stated that I can issue a summons to the person who hit me for careless driving, and I will have to go to court. This is basically to show them that I'm not messing around. All I want is my BRAND NEW car fixed!!! I'm NOT going through my insurance because my deductible is $1,000, and the damage is less...not only that...it wasn't my fault! My insurance company advised me to have person who hit me's insurance take care of everything, at no cost to me. Here's what I need to find out...Can I send the person a demand letter, basically stating that I want them to have their insurance take care of everything? I have tried to call them, and they send me to voice mail, so reasoning is not an option any more. I don't really know how to go about this?! I want to try this on my own, and not get an attorney involved. I just want to tell them that if they fix my car, I will drop summons and further proceedings (like small-claims court, which I WILL sue for additional $$ for dealing with all this). But, what if they don't have the money? I have no idea what to do. I live in NJ, hope someone can help!

Auto Insurance - what went wrong here?

Where did I go wrong? A few months back, I backed out of a parking place and stopped, waiting for traffic behind me to resolve itself. While stopped, a large vehicle backed into my driver side door. We both re-parked. The other driver first tried to convince me there was no damage and we should both forget it but after I showed him the damage to my door (his car had almost no damage), we exchanged insurance and personal contact information in a friendly conversation. I reported the damage to my insurance carrier, a large national firm, obtained the required 2 estimates for repair and submitted it, as directed by my carrier and his, to his carrier, a large regional carrier. They informed me he had decided my car was not stopped and so I bore responsibility for his backing his car into me (!), and they therefore were refusing to pay me. My insurance carrier said it was up to me to provide proof my car wasn't moving, regardless of the fact his car backed into mine! I approached the repair firm, and they provided me with photos and offered testimony to state that my car was obviously stopped, based on the damage to the door. I called the individual and said with this information unless he paid the bill in full, I would take him to small claims court. He argued but produced a check for the full amount. A month later, my insurance carrier raised my rate based on this incident and a highway speeding ticket over a year ago. I ended up paying more for my insurance and lost a great deal of time despite both of us being insured. Where did I go wrong?

While all of this is going on, the car is depreciating at an almost exponential rate and the top it all off, it is a requirement by our government to pay for it. Now I do undestand its place but there needs to be some type of adjustment in the way that this system works. I mean, while they're collecting money on your insurance, they are reinvesting it and making money off of your money that you will never get back and ultimately never use....I'm annoyed. I feel like I am just throwing money away. What do you think?

My mom was seeing a psychiatrist and on lots of meds a few years ago. She since lost her job and kaiser and all the insurance companies won't cover her. She's been sick for two weeks and had to go to the emergency room yesterday. I just got into an accident 5 days ago. I still don't believe it was my fault if anything maybe both of ours. Regardless she had minor damage. i had posted this question earlier just not in the right way.so i have a car and its not under my name because im so young to have a new car with insurance under my name so its all under my aunts name. the insurance and everything else is in her name but its my car.so i have to go on a business trip to Vegas and my aunts flipping out!!! because she says i cant take the car because the insurance its not in my name and the car isnt either so im just really frustrated trying to figure out what to do besides flying?can she buy insurance for a couple days so i can go?

I'm assuming I'm around 14 maybe 15 weeks pregnant & I haven't had any prenatal care nor do I have health insurance. With my first pregnancy I qualified for Medicaid & left the HHS that day with it! This time they have been dragging me around since March, losing things, accidentally deleting files, denying me & then asking me to reapply. All of this over & over again, it's just been very unorganized & stressful. Not to mention I had a meltdown & told them that I NEEDED TO GO TO THE DOCTOR, so please let me know what to do! Naturally though, I can't receive insurance through his job until we are officially married. We attempted to make an appointment & self pay, but during that one visit they demanded $600 up front, which we weren't prepared for. I refuse to go to a clinic simply because my last pregnancy was high risk & ended in an emergency C-Section & there were complications & I'm sure this one will be the same, since I ended up getting pregnant before the desired waiting time for a previous c-section. Not to mention, my OB/GYN has been my doctor since I was 13 & he is truly the best where I live. I just wouldn't be able to trust someone else. I live in Texas by the way. I got a ticket on my very first day of driving for an illegal left turn (one of those that you cant make during certain hours unless you are a resident of the street). I got the ticket with 3 points, i went to court and paid off all 3 points and got unsafe driving under my name hoping that it wouldn't affect my insurance, which was under my dads name (Allstate). My parents' only reason for not letting me drive is because they are misinformed as far as what the penalties would be if I got stopped. Why does California suck so much?!?!?

UGH! I'm a teenager, who drives a 2001 Honda Accord, right? I've been driving for almost two years (this November) and I had my insurance set up that I pay it every 6 months and it would accumulate to $720.90. I've always paid my insurance a week or two ahead of time and my driving record is perfect thus far. But then, I get my insurance this time and now it's $777.90 dollars!!! It increased $57 out of nowhere. I called and it's because of North Carolina doing a business deal with California and California increased everything or something. I know that sounds sketchy. I have Progressive, by the way. And no, they don't offer any student discounts (I got straight A's when I was in high school and now I'm in college and I still get them) but they don't acknowledge that because California or whatever took the rights away to lend out such discounts. My question is: why does California suck so much? It isn't fair whatsoever... $1600 (almost) a year for insurance on a 2001 Honda Acoord is ridiculous. So I'm going for my license soon and we're starting to look at cars to get me around. I want something that's pretty easy on gas, reliable, easy on car insurance cost, doesn't cost an arm and a leg but ALSO isn't a tiny car like the Chevy Aveo because most of the people in my family are pretty tall for instance my mom is 5'9 I'm 5'7 /5'8 and my other sisters are also about the same height. I've been thinking about the Prius because I hear it's got some leg room and is easy on gas, but people say that batteries are more harmful than regular ones and all this jazz. Then I thought about the Honda Insight but I heard that the headroom in the back is not comfortable. I was thinking the Hyundai Sonata, but the only model I really like is the 2011 and I don't think the insurance company takes kindly to teenagers driving new cars. I would prefer not too big or long a car like the Toyota Avalon, but it's manageable. Any suggestions?

I have USAA as my auto insurance. Here's the back story. I was parallel parked alongside a street here in Atlanta and a car (more than likely) was trying to get out of his/her space and hit the left driver side bumper pretty hard (ruining the paint and loosening up the bumper pretty good...and cracking the tail light). This person did not leave a note. I have my 500 deductible. I also have uninsured motorists coverage. Right now USAA is saying that I will have to pay the $500 ded. Will My Car Insurance Go Up?

I was Driving down a road going about 35-40 mph. ( Speed Limit was 45 mph ) I was going straight, and this woman coming the opposite direction decides to turn into a cut out, that goes into a shopping center, and as she turns in to the cut out she just keeps going, out into the street I slam as hard as I could, on my brakes but I still hit her, I hit her on the passengers side in between the 2 doors. My Neck and back is still hurting me a lot more, from the accident, I have too wear a sling on my left arm / shoulder because of the force of the seat belt. My nose is swollen do to the impact of the air bags, also affected my neck, and head pain. I have marks on my right arm, and stomach from this. Now the air bag deployed in my truck, and all of the air bags deployed in her car. My Truck looks like it will probably be totaled the bumper is ruined, the hood is ruined, the headlight is broken, The door I had to practically pry open because it was stuck, Smoke started coming out of the truck headlight broken Paint, I think the radiator broke, etc.... etc... Both Vehicles had to be towed away. I have good insurance on our cars, but since this isn't my fault the other woman's insurance will have to pay my medical bills, and to fix my truck, or give me blue book value on it right? I am 20 years old, I live in Las Vegas, Nevada. My insurance is Allstate, and the Other Woman's insurance is allstate also. I will be getting a lawyer.

After a recent visit to the ER due to a esophageal stricter which scared us thinking Chest pain! Spent 16 hours being observed and tested! Finally send down to endoscopy for a esophageal dilation! Did the job!! I was sent home 4 hours later! Now two weeks later I get a phone call from my Primary care Doctors office manager saying that my primary received a memo from my health insurance (after my ER visit) company and I was instructed to call and make an appointment for alcoholism counseling???? The night of the incident where I couldn't swallow, and was in pain! we had guests over and had a few beers! I gave the attending ER doctor all information including I had drank beer an hour before I got there. OK, now, For the 16 hours at the hospital and the multiple blood tests, everybody including the Dr's said everything looked good! and the Dr. that discharged me explained to my wife in detail about my blood work, said things were fine. So, why would my CHP (Capital Health Plan) health insurance company be contacting my primary? Especially about alcoholism counseling, this has NEVER been an issue in the past! I'm so upset! I've been with my primary for over 15 years and due to a knee injury he prescribes me mild pain killers, and Florida Law makes him take a urine sample every 3 months! Again this has never come up. A guy at my college hit my car the other day, and the (lowest) estimate was $1,029. I only paid $1,650 for the car, so it feels like $1k is a little to much for a dent. A couple of weeks ago a lady ran a red light and hit my car. Her insurance company took a week to get me a rental and two weeks later finally go look at my car and determined a total loss. The adjustor was pretty rude about the whole situation (yes I know that's their job) and started in on how my car has extensive hail damage which is not true. There were some dents from hail on the hood and trunk lid but every used car in Oklahoma has hail damage since we have had several storms over the past few years. He said that they would have paid $5900 for the car but because of the hail damage they will only pay $1250 which is ridiculous. I've done my research and the average cost of my car within 200 miles is $6000 and I have received one estimate on repairing all of the damage was $2000 yet he claims it will cost $7000. The dealership I bought the car from just sold a vehicle just like mine with hail damage for $5000. The engine and everything else on the car was perfect. When I told him all of my info he laughed at me and said oh by the way we are only paying for your rental till the 9th so you need to settle quickly, take it or leave it so I said I was calling a lawyer. I'm waiting on the lawyer to call me back but I just want to know, what should I look for to help me. I've already looked at the market in my area and have record of the prices for the same make and model. I can't take it to a body shop because the car is crushed. Any info appreciated.

I had State Farm insurance. They raised my rate...I cancelled. After I cancelled they drafted my account for the amount due the following month. So I paid the new insurance and State Farm. Hi, I'm 16 years old and I currently have a 2002 Gmc Envoy, and I love the qualities of the car, but the brakes are horrible and it's crash test rating is really low. I've had people pull out in front of me on more than 2 occasions and my brakes take so long for the car to stop so im really nervous when driving it. I want to trade it in and get a 2000-2005 ford expedition because its on the same platform as my dads f-150 and when I drive his truck the brakes are so much better and I have better visibilty, the expedition is also better in crashes. Low Cost Health Insurance (Indiana)?

I was apart of the Medicaid program but then some way some how lost my eligibility for the program. I am 24, and do not smoke. All of the companies I have looked at quotes for are way to high. While I know it is ridiculous to think that I will receive a monthly payment as low as I was receiving while I had Medicaid, which was only $16 a month, I need to find a company, and plan that provides coverage to low income individuals fresh out of college that don't have a lot of money to spend. It would be nice if it was under $50 and still managed to cover most of the things that I need, generic drug coverage, and doctor office visits. Does anyone have a clue where and how I would be able obtain some kind of insurance that will not bankrupt me in the process? And my employer is not an option because they do not offer benefits packages. Please help!!

Why is my insurance going up?

I've been working with my employer for 7 years, as of right now I have employee & spouse coverage, I pay about 150 a month (auto deduct from paycheck) and that amount gets me a $5000 deductible and about a $25-$30 co-pay. this morning in a company meeting we were told that our insurance is going to go up (starting June 1st) now for employee and spouse it is going to be $410 a month (everything else the same as before co-pay and deductible) last year my hubby had some medical issues and we have about $7000 in medical bills (on a payment plan we pay $400 a month) so now when my new rate kicks in (in about a week) I will have to pay a total of $800 a month just for medical stuff... I can't afford this. my employer is very upset and wants to shop around but has been shopping around for 8 months now and can't find anything better than this. why is health insurance rising?? I am thinking about dropping myself from health insurance all together (I am 31 and healthy), also i plan on getting rid of my cable and internet (which would save $140 a month), my husband (with medical issues) will get health insurance through his work (about $160-$200 a month) and I will go without for a couple of years just so we can keep our heads above water... This might be long but PLEASE READ EVERYTHING. When I was 15 my grandfather (Legally my father, always lived with him) had always promised me he would get me driver's ed but he never did. Help understanding auto insurance settlement and if I need to seek legal help?

My 17 year old son was driving his 2003 Ford Explorer, when he was hit by another vehicle. My son was approaching a stop light and traveling between 3-5 mph....The vehicle that struck him was a company work vehicle. The work truck was pulling out of a parking lot when he hit my son. His estimated speed was also 3-5 mph. There were no injuries at all, and there was no medical treatment sought. This all happened on April 10th 2011. It was found that driver of the work truck was at fault for inattention. Honestly, this guy was super nice and walked my son through the process of calling police etc til I could get there....Now dealing with the Companies insurance carrier has been a headache!!!! here is the basic timeline....Explorer still drivable....Had to wait 10 days for police report....contacted Company that owned work truck, and they forwarded me to their insurance co....Was advised to seek several estimates, and fax them over....Faxed over estimates to adjuster. All estimates exceeded 5k....Stated she would have to contact an adjuster from local area to work this. Local adjuster came out. Estimated damages to be 3300.00. Insurance Company sent me check for 3300.00 and advised me when vehicle repaired, auto shop would need to work with adjuster on any additional repairs and costs. Explorer was in shop 30 days before finally being totaled. Local adjuster was horrible to work with, did not communicate with body shop, etc. I finally contacted the insurance company, and told them I refused to deal wither contracted adjuster etc. Now that the vehicle has been totaled, they don't want to pay what I think is fair. The insurance company wants to settle for $6928 plus $367 for taxes. Clean retail for the Explorer is $8100. This is for my area. I have been car shopping for 2 days straight. can't find anything comparable with the money they gave me etc. I have taken off work to deal with this etc, been going on for 2 months plus, and Iam worn out with it all...All I want is for my kid to be back in a safe reliable vehicle. The insurance company did provide a rental car. I had to drive it, my son had to take my car, my other son had bought our car from us, but can't get it yet, because the other needs it for work school etc....I am so frustrated with the ins ompany

My windshield was really frosty but I only had to drive like 20 yards to get where I wanted. So like an idiot, I start driving and run into a fire hydrant. This damages the front right quarter panel, the right blinker, and it may have also damaged the axel or steering column because I couldn't get my car to move after that. A family member is diagnosed with something similar as cancer. She works for a big fortunate 500 company and so far, there is no sign the company will fire her. I did a little test to check quotes when it came to auto insurance through Progressive. I found that I would pay less a month for choosing the option that I have had insurance for the past five years, but when I choose I haven't had insurance it charges me more per month. I technically have not had insurance before. My last vehicle was on my brothers insurance policy and I was listed as an Additional driver. So should I choose that I haven't been insured? I obviously wouldn't drive without insurance, even though I do live in a state that does not require it - but I don't want to give the notion that I have been either. Secondly, if your car is paid for then you only have to have liability insurance to protect others not for the repairs of your own car. False County Court Claim Against Me on My Car Insurance?

Someone has put a claim in against me for damages, for an accident I know nothing about. It is from early 2010 and has been going on since then. I have been contesting it on the grounds I have not been involved in an incident, however the third party solicitors have issued County Court proceedings against me. My insurance company are saying they are putting in a defence and have provided a barrister. I am really annoyed with this as I know I haven't been in an accident. I could understand if maybe they were claiming I clipped them and I had done it without realising but they are claiming for an accident which I have no knowledge of! I have attended the Magistrate's Court hearing and although I pleaded not guilty I have been found guilty on the grounds that for the time and date of the accident I have no alibi, witness or other evidence to support my whereabouts. The other party has an independent witness who works for the same company and alleges she could recognise my car but not me as a driver. Mag court fined me and gave me 6 points on my licence. I am not working (and not in receipt of any benefits) and this CC claim amounts to 5k! How would I pay a sum like this??? Or would my insurance company pay out if I was found to be at fault ??? Please help! Where do I stand on this? Any help appreciated. Thanks!

I was traveling at 40 m.p.h. at a 45 mile zone, a vehicle ran a stop sign and I hit him broadside, now their ins.co. wants me to accept $10,000 (since thats the coverage he supposedly had) on a vehicle I owe $21,000. I live in Tennessee and moving down to Florida in early August and in Tennessee at age 16 you can get a license called Intermediate Restricted Driver License which just has more restrictions then a 17 year old and less restrictions then a 15 year old/permit. I'm not sure if Florida has these type of licenses but at the age of 16 with a Tennessee Intermediate Restricted License, to get a Florida license, must you show proof of insurance before you get your Florida license?
